What's changing in NSW building rules in 2026

New building approval terms. NSW Parliament passed the Building (Approvals and Practitioners) Bill 2026 in August 2026. Construction certificates will become “building approvals” and occupation certificates “completion approvals” (MinterEllison). 

Owners apply. Under the new Act, only owners, or builders with the owner’s consent, can apply for a building approval. 

Tougher certifier penalties. Maximum penalties for certifiers rise from $33,000 to $1.1 million. 

Start dates. Most provisions begin on dates set by proclamation, so check the current status before relying on the new terms. 

NCC 2025: what it means for houses 

NCC 2025 is out, but building ministers have paused new residential changes until mid-2029. For houses, NCC 2022 remains the benchmark, including the 7-star energy efficiency standard (The Good Builder).

R2 vs R3 zoning NSW — what you can actually build

NSW R2 and R3 sit one step apart on the zoning table and a long way apart in what they let you do. The difference is worth understanding properly, because the gap between them is where most small-scale development feasibility in Sydney is won or lost.

One warning before the detail. Zones in NSW come from the Standard Instrument LEP, but the land use table for each zone is set by each council’s own LEP. Two councils can both have R3 land and permit different things on it. Everything below is the pattern; the specific address is always the council’s LEP.

What the two zones are for

R2 Low Density Residential is the standard suburban zone — detached houses, and in most councils dual occupancy, on lots that meet a minimum. Its objective is to keep the low-density character while allowing a modest increase in housing. 

R3 Medium Density Residential is the step up. Its objective is to provide a variety of housing types, and the land use table usually adds multi dwelling housing, attached dwellings, and often residential flat buildings and manor houses. On paper that is a different development altogether. 

The practical difference

the minimum, or a subdivision into two lots. Yield is capped by the minimum lot size and the frontage rule far more than by anything else. 

On an R3 lot of the same size, multi dwelling housing may be permissible, which changes the arithmetic entirely — three or four dwellings on a parcel that would have made two lots in R2. That is the whole reason developers filter for R3. 

What does not change between the zones: floor space ratio, height of buildings, setbacks, deep soil and landscaped area, and parking. These sit on separate LEP maps and in the DCP, and they routinely bind before the zone does. An R3 lot with a 0.5:1 FSR and a 8.5 metre height limit will not deliver what the zone appears to permit. 

Read the land use table, not a summary

Every LEP contains, for each zone, three lists: permitted without consent, permitted with consent, and prohibited. That table is the answer and it is public. Find the council LEP on NSW legislation, go to Part 2 Land Use Table, find the zone. 

Do that before trusting any summary, including this one. Councils vary a great deal — some permit dual occupancy in R2 broadly, others only above a lot size, and a few not at all. A summary table on a blog is a starting point, never a basis for an offer. 

State policies that override the zone

The council LEP is not the only instrument. State Environmental Planning Policies sit above it and can permit development the local land use table does not, or set their own standards for it. Low-rise housing diversity provisions, seniors housing, affordable housing and complying development pathways all work this way. 

This cuts both ways in feasibility. A site that looks limited under the LEP may have a state pathway; a site that looks generous may be caught by an overlay the zone map does not show. 

How to check a specific address

Open the NSW Planning Portal Spatial Viewer, search the address, and read four layers in this order: Land Zoning, Lot Size, Height of Buildings, Floor Space Ratio. Then open the council LEP land use table for that zone, and finally the DCP for setbacks, frontage and landscaped area.

Generally no — multi dwelling housing is usually prohibited in R2. A dual occupancy may be permitted if the lot meets the minimum. Check the council land use table.

There is no state-wide minimum lot size for a dual occupancy in NSW. Every council sets its own, some set a different figure for attached and detached, and many add a minimum street frontage in the development control plan that fails sites the area test would have passed. 

This page collects those figures for Greater Sydney councils, with the date each one was checked and a link to the source. It is a starting point for a feasibility, not planning advice — controls change, and the council LEP is always the authority. 

Area is not the only test

Three controls decide whether a duplex fits, and they are usually in three different documents. 

  • Minimum lot size — in the LEP, sometimes on the Lot Size Map, sometimes as a specific dual occupancy clause with a different figure. 
  • Minimum street frontage — usually the DCP. A 600 m² block with 12 metres of frontage can fail a 15 metre rule while clearing the area test comfortably. 
  • Whether the result can be subdivided — some councils permit the dual occupancy but not the Torrens subdivision of it, which changes the exit and the finance.  

A table of areas alone gives you one of three answers. That is why the columns below include frontage and subdivision.

How to confirm it for your address

Where the LEP and this table disagree, the LEP is right and we want to know — there is a correction link at the foot of the page.
