Introduction

These terms and conditions govern your use of BuilderApp.au and set out the tradie marketplace terms Australia homeowners and tradespeople must agree to before using our platform. By registering or using BuilderApp.au, you agree to be bound by these terms in full.

Please read this agreement carefully before proceeding.

BuilderApp.au (“BuilderApp”, “we”, “us”, “our”) operates an online platform connecting homeowners and businesses (“Homeowners”) with qualified tradespeople (“Tradies”) across Australia.


1. Platform Overview

1.1 BuilderApp provides a digital platform where Homeowners can post jobs and receive quotes from registered Tradies.

1.2 When a Homeowner accepts a Tradie’s quote, a Job Contract is formed directly between those two parties.

1.3 BuilderApp acts as a facilitator only. We are not a party to any Job Contract between a Homeowner and a Tradie.

1.4 A Homeowner may edit or withdraw a posted job at any time before accepting a quote.

1.5 Once a quote is accepted and a Job Contract is created, both parties are expected to honour their obligations under that contract.

1.6 After job completion, both parties are encouraged to leave honest reviews and ratings on the platform.


2. Eligibility

2.1 You must be at least 18 years of age to register on BuilderApp.au.

2.2 By registering, you confirm that all information you provide is accurate, current, and complete.

2.3 Tradies must hold a valid ABN and any trade licences required to perform their nominated services in their state or territory.

2.4 BuilderApp reserves the right to refuse, suspend, or cancel any account at its sole discretion, including where a user’s conduct is harmful to the platform or other users.

2.5 Users may register as individuals or on behalf of a business entity, provided they have authority to act on behalf of that entity.


3. User Obligations

3.1 All users must at all times:

  • Comply with these terms and all applicable Australian laws and regulations
  • Provide accurate and truthful information on the platform
  • Maintain full control of their BuilderApp account
  • Not allow others to use their account on their behalf
  • Not use the platform for any unlawful, fraudulent, or harmful purpose

3.2 Homeowners must not misrepresent the scope, location, or nature of a job when posting.

3.3 Tradies must:

  • Hold and maintain all licences, insurances, and permits required to perform their listed services
  • Have the legal right to work in Australia
  • Comply with all tax obligations including GST where applicable
  • Not charge Homeowners outside of the BuilderApp platform once a Job Contract is formed

3.4 Users must not post content that is false, defamatory, offensive, discriminatory, or in breach of any third-party intellectual property rights.

3.5 Users must not attempt to divert transactions or communications off the BuilderApp platform to avoid platform fees.

3.6 BuilderApp may remove any content, listing, or account that violates these terms without prior notice.


4. BuilderApp’s Role & Limitations

4.1 BuilderApp provides the platform infrastructure and is not responsible for the quality, safety, legality, or completion of any services performed under a Job Contract.

4.2 BuilderApp does not verify the accuracy of information submitted by users, including qualifications, licences, or experience, unless a specific verification badge has been issued.

4.3 BuilderApp does not guarantee the availability of Tradies in any location, or that a Homeowner’s job will receive quotes.

4.4 Users agree to release, indemnify, and hold harmless BuilderApp from any claims, losses, or liabilities arising from interactions between Homeowners and Tradies.

4.5 BuilderApp may, but is not obligated to, assist in resolving disputes between users.


5. Fees & Payments

5.1 Registration and job posting on BuilderApp is free for Homeowners.

5.2 Tradies may be subject to platform fees as displayed on the BuilderApp pricing page at the time of account registration or subscription renewal.

5.3 All fees displayed on the platform are in Australian dollars (AUD) and inclusive of GST where applicable.

5.4 BuilderApp reserves the right to amend its fee structure at any time. Users will be notified of material fee changes prior to implementation.

5.5 Payments processed through BuilderApp are handled by a third-party payment provider. By using the payment facility, you agree to that provider’s terms and conditions.


6. Cancellations & Refunds

6.1 A Homeowner may cancel a posted job before a quote is accepted with no penalty.

6.2 Once a Job Contract is formed, cancellations may incur fees as outlined in the platform’s current fee schedule.

6.3 Where a Tradie cancels a confirmed Job Contract without reasonable cause, BuilderApp may record the cancellation against that Tradie’s profile.

6.4 Refund requests arising from disputed job outcomes should be submitted to BuilderApp support within 14 days of the job completion date.

6.5 BuilderApp may take up to 7 business days to process any applicable refunds.


7. Verification & Badges

7.1 BuilderApp may offer identity, licence, or insurance verification badges to Tradies.

7.2 Verification badges represent a point-in-time check only and do not constitute an ongoing guarantee of a Tradie’s credentials or fitness for purpose.

7.3 Homeowners are encouraged to independently verify a Tradie’s credentials before engaging their services.

7.4 BuilderApp may remove a verification badge at any time where it determines the badge is no longer valid or was obtained on false grounds.


8. Intellectual Property

8.1 All content on BuilderApp.au, including logos, platform design, software, and written content, is the intellectual property of BuilderApp and may not be reproduced without written permission.

8.2 By posting content on BuilderApp (including job descriptions, images, and reviews), you grant BuilderApp a non-exclusive, royalty-free licence to use that content for the purpose of operating and promoting the platform.

8.3 You confirm that any content you post does not infringe the intellectual property rights of any third party.


9. Reviews & Ratings

9.1 BuilderApp encourages honest and accurate reviews from both Homeowners and Tradies following the completion of a job.

9.2 Reviews must not be false, defamatory, or motivated by personal grievances unrelated to the job performed.

9.3 BuilderApp reserves the right to remove reviews that violate these terms or its community guidelines.


10. Dispute Resolution

10.1 Users are encouraged to resolve disputes directly and in good faith before contacting BuilderApp.

10.2 Where a dispute cannot be resolved directly, either party may submit a formal dispute to BuilderApp support at support@builderapp.au.

10.3 BuilderApp may, at its discretion, review available evidence and make a reasonable determination on the outcome of the dispute.

10.4 BuilderApp’s determination does not prevent either party from pursuing resolution through the applicable Australian courts or tribunals.

10.5 This agreement is governed by the laws of New South Wales, Australia. Users submit to the non-exclusive jurisdiction of the courts of New South Wales.


11. Privacy

Your use of BuilderApp.au is also governed by our Privacy Policy, available at builderapp.au/privacy-policy. By using the platform, you consent to the collection and use of your personal information as described in that policy.


12. Termination

12.1 Either party may terminate their BuilderApp account at any time by contacting support@builderapp.au.

12.2 BuilderApp reserves the right to immediately suspend or terminate any account that breaches these terms.

12.3 Termination does not affect any Job Contract already in progress between a Homeowner and a Tradie.

12.4 Sections 4, 5, 8, 10, and 11 survive termination of this agreement.


13. Limitation of Liability

13.1 To the maximum extent permitted by Australian Consumer Law, BuilderApp’s liability to any user is limited to the total fees paid by that user to BuilderApp in the three months prior to the event giving rise to the claim, or AUD $50.00, whichever is greater.

13.2 BuilderApp is not liable for any indirect, special, or consequential loss arising from use of the platform or any Job Contract formed through it.

13.3 Nothing in these terms excludes any Non-Excludable Condition under the Competition and Consumer Act 2010 (Cth).


14. Modifications to These Terms

14.1 BuilderApp may update these terms at any time. The updated version will be posted at builderapp.au/terms with a revised date.

14.2 Continued use of the platform after notification of changes constitutes acceptance of the updated terms.

14.3 If you do not agree to the updated terms, you must cease using the platform and contact us to close your account.
